6.Contract description:The contract involves developing an irrigated perimeter measuring 2 548 ha net (firm phase) as well as works to extend the Kalankorla drain (optional phase). For the firm phase, the main works are described as follows:1. works to develop an irrigated perimeter measuring 2 548 ha net (firm phase): — earthworks for the primary irrigation and drainage network: • Tiongoni distribution facility,• Tango drain,• Kalankorla drain,— earthworks for the secondary irrigation and drainage network: • construction of all distribution channels (except for BT08, BT10, BT13 and BT16) on the right bank of the Tango drain (zone fed by the Tiongoni distribution facility) and structures associated with said channels, including intake structures for the watering channels (with "modules à masques") and the watering lines, serving cultivation facilities in model M1D (see the detailed preliminary study), safety outflows, drop structures, washing places, • construction of all distribution drains (except for DRT07, DRT08, DRK9, DRK10 and DRT12) on the right bank of the Tango drain (zone fed by the Tiongoni distribution facility) and associated structures, including structures at the end of tertiary drains carrying water away from cultivation facilities in model M1D,— earthworks for the tertiary irrigation and drainage network: works for open tertiary channels, including tertiary drainage networks on the right bank of the Tango drain,— earthworks for paths (with laterite surfacing — 4-m top width) on the right and left banks of secondary drains and channels, — plot development works: preparatory levelling works: removing surface soil, clearing undergrowth, removing stumps and flattening the ground, including termite mounds; levelling works, including pulverising and loosening soil for crops, — various works: rip rap, masonry revetment, geotextile;2. construction and equipping of living quarters and offices for the works overseeing and inspection assignment at M"Béwani (firm phase). The optional phase (or works as an option) is for works to extend the Kalankorla drain (recalibration of the downstream section) and structures associated therewith (construction of dam paths on the right and left banks, outlet structures for catchment areas, etc.). This optional works phase may be entrusted to the contractor under a negotiated procedure without prior publication of a contract notice, if the contracting authority determines that the balance of the budget for the works in the firm phase (development of the irrigated perimeter measuring 2 548 ha net, and construction and equipping of living quarters and offices for the works overseeing assignment) is sufficient and that the progress of said works is sufficient and satisfactory in relation to the planned period.

7.Number and titles of lots:• 1 lot only. • Lot title: works to develop an irrigated perimeter of 2 548 ha net in the Tiongoni rice zone (firm phase) and works to extend the Kalankorla drain (optional phase).

8.Eligibility and rule of origin:Participation in the contract is open on equal terms to all natural persons and legal entities (participating either individually or as part of a grouping — consortium — of tenderers) established in an EU Member State, an ACP country or a country or territory authorised by the ACP-EC Partnership Agreement under which the contract is financed (also see point 22 below). Participation is also open to international organisations. All supplies and equipment procured under this contract must originate in 1 or more of these eligible countries. They may come from any country if their value does not exceed 100 000 EUR.

9.Grounds for exclusion:Tenderers must provide a signed declaration, included in the tender form for a works contract, confirming that they are not in any of the situations listed in point 2.3.3 of the Practical Guide.

10.Number of tenders:Tenders can be submitted for the single lot in question. Tenders for part of the lot will not be considered. Tenderers may state in their tender whether they are prepared to grant a discount should their tender be accepted. Tenderers may not submit a variant tender in addition to their tender for the works required in the invitation to tender dossier.

11.Tender guarantee:Tenderers must provide a tender guarantee for 1 % of the tender value when they submit their tender. This guarantee will be returned to unsuccessful tenderers once the invitation to tender procedure has been completed and to the successful tenderer after the contract has been signed by all parties.

12.Performance bond:The successful tenderer will be required to provide a performance bond for 10 % of the contract value when the contract is signed. The tenderer will have 30 days from the date on which he receives the contract signed by the contracting authority in which to provide the bond along with the countersigned contract. If the successful tenderer does not provide the required bond within the time allowed, the contract will be rendered void and a new contract may then be drawn up and sent to the tenderer who submitted the second lowest-priced compliant tender.

13.Briefing and/or site visit:A briefing following by a site visit will be organised according to the following schedule: • Ségou and M"Bèwani: 27.11.2017 (9:30).• NB: the site visit is mandatory.

14.Tender validity:Tenders are to be valid for 90 days from the final date for submission of tenders. In exceptional circumstances, and before the tender validity period expires, the contracting authority may request that tenderers extend the validity of their tenders for a stipulated number of days.

15.Implementation period for the tasks:The overall contract performance period is as follows: • single lot: 24 months, including the rainy season.

16.Selection criteria:Tenders will be selected on the basis of an administrative compliance grid and a technical evaluation grid, in accordance with the criteria described in point 12.2 of the instructions to tenderers.

17.Award criteria:The most economically advantageous tender is the lowest-priced technically compliant one.

22.Repetition of similar works:Subsequent to the initial contract resulting from this tender procedure, new works consisting in the repetition of similar works up to an estimated amount of 50 % of the value of the initial contract may be entrusted to the initial contractor by negotiated procedure without prior publication of a contract notice, provided that the new works conform to the basic project.

23.Legal basis:Annex IV to the Partnership Agreement between the members of the African, Caribbean and Pacific Group of States and the European Community and its Member States, signed in Cotonou on 23.6.2000, as amended in Luxembourg on 25.6.2005 and in Ouagadougou on 22.6.2010. Reference is made to Annex IV as revised by Decision No 1/2014 of the ACP-EU Council of Ministers of 20.6.2014.
